The Service allows users to manually input data, create visual funnel maps, adjust conversion rates and statistics in projection mode, and receive automated recommendations regarding key performance indicators (KPIs), conversion optimization strategies, and suggested actions.

The Service may include current and future features such as, but not limited to: web scraping, automated data collection from user-provided URLs, artificial intelligence-powered analysis, third-party integrations, and other functionality that may be added, modified, or removed at our sole discretion without notice.

3. NO BUSINESS ADVICE — DISCLAIMER OF RECOMMENDATIONS

CRITICAL: YOU UNDERSTAND AND AGREE THAT:

(d) YOU ACKNOWLEDGE THAT FOLLOWING THE SERVICE'S RECOMMENDATIONS MAY RESULT IN FINANCIAL LOSSES, DECREASED BUSINESS PERFORMANCE, LOST REVENUE, COMPETITIVE DISADVANTAGE, OR OTHER NEGATIVE OUTCOMES. YOU ASSUME ALL RISK AND LIABILITY FOR DECISIONS MADE BASED ON THE SERVICE.

(e) You should consult with qualified business advisors, accountants, lawyers, and other professionals before making any significant business decisions. The Service is not a substitute for professional advice.

4. Artificial Intelligence and Third-Party Technology Disclaimer

The Service utilizes artificial intelligence technologies provided by third-party vendors including, but not limited to, Anthropic, OpenAI, and other AI service providers. You acknowledge and agree that:

(a) AI-generated content, analysis, and recommendations are experimental, probabilistic, and may contain errors, hallucinations, biases, or inaccuracies.

(b) AI systems may produce inconsistent results when given the same input at different times.

(c) We do not control, verify, or validate the accuracy of outputs from third-party AI services.

Paid subscriptions are processed through Stripe via Clerk Billing. By subscribing to a paid plan, you agree to: (a) Pay all applicable subscription fees as disclosed at the time of purchase; (b) Automatic recurring billing until you cancel your subscription; (c) We reserve the right to change pricing at any time, with changes applying to subsequent billing cycles.

REFUND POLICY: We offer a 30-day money-back guarantee. To request a refund, email support@conversionplaybook.com within 30 days of your initial purchase. Refunds are not available for renewals or after the 30-day period. Refund requests are evaluated on a case-by-case basis and we reserve the right to deny any refund request for any reason.

8. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, for any reason, without notice or liability. Reasons for termination may include, but are not limited to: (a) Violation of these Terms; (b) Abusive, fraudulent, or harmful use of the Service; (c) Non-payment of subscription fees; (d) At our sole discretion for operational, legal, or business reasons. Upon termination, your right to use the Service ceases immediately. We are not obligated to preserve or provide access to any data, content, or account information after termination.

The Service, including all software, content, trademarks, logos, and materials, is owned by Conversion Playbook and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your personal or internal business purposes. You may not: (a) Copy, modify, distribute, sell, or lease any part of the Service; (b) Reverse engineer, decompile, or attempt to extract source code from the Service; (c) Remove or alter any proprietary notices or labels.

You retain ownership of any data, information, or content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and analyze your User Content solely for the purpose of providing the Service to you and improving the Service. You represent and warrant that you have all necessary rights to submit User Content and that your User Content does not violate any third-party rights or applicable laws.

We reserve the right to add, modify, or remove features of the Service at any time without notice. We are not obligated to maintain any particular feature or functionality.

The Service integrates with third-party services including Stripe (payment processing), Clerk (authentication and billing), Anthropic (AI services), OpenAI (AI services), and potentially other vendors. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or performance of third-party service providers.

You agree not to: (a) Use the Service for any illegal purpose or in violation of any laws; (b) Attempt to gain unauthorized access to the Service or other users' accounts; (c) Interfere with or disrupt the Service or servers/networks connected to the Service; (d) Use automated systems (bots, scrapers) to access the Service without permission; (e) Engage in any fraudulent, abusive, or harmful activities.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CONVERSION PLAYBOOK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

You agree to indemnify, defend, and hold harmless Conversion Playbook and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your use of the Service; (b) Your violation of these Terms; (c) Your violation of any third-party rights; (d) Business decisions made based on recommendations provided by the Service.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

You agree to first attempt to resolve any dispute informally by contacting support@conversionplaybook.com before initiating any formal proceedings.

WAIVER OF CLASS ACTIONS: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

WAIVER OF JURY TRIAL: YOU WAIVE YOUR RIGHT TO A JURY TRIAL IN ANY DISPUTE RELATED TO THESE TERMS OR THE SERVICE.
